New Regulations on Work Permit for Foreigner 2022

Foreign workers who have been granted a work permit in Vietnam, but the work permit is about to expire, need to renew the work permit to be able to continue to work legally and to be protected by the law. There are new regulations on work permits for foreigners in 2022 not everyone knows.
Work permit for foreigners in Vietnam is considered the highest legal basis to ensure legal conditions for foreign workers to work legally in Vietnam. Therefore, after being granted a work permit in Vietnam, foreigners who continue to work at the licensed unit when it expires can have their work permit extended.
New regulations on work permits for foreigners 2022
- With a work permit for foreigners issued before 2021, it is not possible to carry out the procedure to extend the work permit for foreigners, but must complete a completely new application procedure.
- Work permits for foreigners issued from 2021 are allowed to be extended once.
Documents of application for extension of work permit for foreigners include:
1. The employer's proposal text for extension of the work permit by regulations of the Ministry of Labor, War Invalids and Social Affairs;
2. 02 color photos (size 4cm x 6cm, white background, straight face, bare head, not wearing colored glasses), photos taken within 06 months from the date of application;
3. An issued work permit;
4. In case the work permit is lost, it must be certified by the commune-level police office of Vietnam or a competent foreign agency as prescribed by law;
5. If there is a change in the contents of the work permit, there must be proofs;
6. In case the work permit is still valid for at least 05 days but not more than 45 days, a health certificate or medical examination certificate as prescribed in one of the documents specified in Clause 6, Article 17 of Decree 152/ 2020/ND-CP;
7. In case the foreign worker has been granted a work permit under the provisions of 11/2016/ND-CP of the Government detailing the implementation of several articles of the Labor Code on foreign workers working in Vietnam must have documents proving that it meets the requirements as prescribed in Article 9 of Decree 152/2020/ND-CP;
Difficulty in applying for work permits for foreigners by themselves
Many customers who are businesses and organizations in Vietnam face difficulties when extending work permits for foreigners for the first time. Some common difficulties include:
- Documents for renewal of a work permit is a complicated procedure that requires many different types of documents.
- Regulations on work permits change frequently. Need to be updated as well as knowledgeable about the law.
- You must carefully prepare the document and have a reasonable explanation with the State officials about that document.
- It takes a lot of time and effort to go through procedures with the competent authority.
In addition, an important point to note: currently the Ho Chi Minh City Department of Labor, War Invalids and Social Affairs will not accept applications directly at 159 Pasteur, Vo Thi Sau Ward, District 3, Ho Chi Minh City.
Instead, applicants will apply online through the portal dichvucong.hochiminhcity.gov.vn
