In addition to providing energy and nutrients for our body through common foods, people increasingly prefer the use of functional foods to comprehensively support the body. However, in order to put products into circulation on the market, individuals and organizations must carry out procedures for announcing functional foods.

1. What is an announce imported functional foods license?

• Announcement of functional foods is a mandatory procedure to carry out when you want to bring products to the market. A functional food product can only be circulated in the market when it has been granted a receipt number by a competent state management agency to receive notice of announcement of functional food product.
• For functional foods without technical regulations, a declaration of conformity with food safety regulations must be made and the declaration of conformity with food safety regulations must be registered at the Ministry of Health (the Food Safety Authority) before being put into the market.
• For functional foods with technical regulations, the regulation conformity announcement must be announced and the declaration of regulation conformity must be registered with the Ministry of Health (Food Safety Department) before being circulated in the market.

2. When do you need to apply for a license to announce imported functional foods?

• The entity responsible for the announcement of products is the organization or individual responsible for bringing the product to market.
• Organizations and individuals that make the announcement must be responsible for the safety, effectiveness and quality of those products in the market.
• Organizations and individuals conducting the announcement must have the function of trading functional foods in Vietnam. If the business does not have this function, it can be registered additional business lines accordingly.

3. Documents to apply for a license to announce imported functional foods

• Declaration of conformity with food safety regulations (for products without technical regulations)
• Detailed product information sheet
• Certificate of free sale (CFS) or health certificate (HC) or equivalent certificate issued by a competent state agency of the country of origin that states that the product is safe for consumer health and in compliance with food legislation
• Product testing results within 12 months, including key quality criteria, safety criteria
• Periodic monitoring plan (certified by the organization or individual)
• Product labels circulated in the origin country and sub-labels in Vietnamese (certified by organizations or individuals)
• Completed product sample for comparison when submitting application
• Business registration certificate with food business line or certificate of legal entity for organizations and individuals importing food
• GMP (Good Manufacturing Practice) Certificate
• Certificate of conformity with standards of HACCP or ISO 22000 or equivalent in case organizations and individuals producing products have a quality management system certified in accordance with HACCP or ISO 22000 or equivalent standards
• Information and scientific documents proving the effects of each ingredient that make up the published function

4. Duration for issuance of certification of declaration for imported functional foods

• The Department of Food Hygiene and Safety (under the Ministry of Health) has the authority to receive the application for registration of regulation conformity and announcement of conformity with food safety regulations.
• The accepting agency shall issue a Certificate of Receipt of the announcement of regulation conformity within 7 days from the day receive a complete and valid document.
• The accepting agency shall issue a Certificate of Conformity with Food Safety Regulations within 30 days from the day receive a complete and valid document.
