Instructions for applying for declaring imported food supplements

Food supplements are functional foods that supplement and enhance micronutrients such as vitamins, minerals, fiber, etc. Because they are used by humans, the food safety standards applied to these products are extremely strict. Declaring imported food supplements is a mandatory procedure that enterprises must perform before selling products to the market.

1. What are food supplements?

The 2010 Law on Food Safety explains in Article 2, Clause 9 as follows: “Functional foods are foods used to support the functions of human body, make our body comfortable, increase resistance, reduce the risk of disease, including foods supplements, health protection food, medical nutrition food”. Thus, food supplements are a form of functional foods.
According to the Ministry of Health, food supplements are foods used to support and supplement the functions of the parts that make up the human body.
Food supplements are often the most easily absorbed nutrients or some substances that the body cannot synthesize on its own; they are delicious, convenient and easy to use.

2. Documents need to prepare

Procedures for declaring imported food supplements include:

  • Product declaration form No.02 of Decree 15
  • Business registration certificate with food business lines
  • Certificate of qualified establishments for food safety
  • The test results within 12 months meet the prescribed criteria
  • Scientific evidence that proves the use of the product or the ingredients that make up the claimed effect
  • Other certifications: ISO 22000:2005 or HACCP certification
  • Product sample, product label sample or product label image
  • Certificate of analysis (CA) - Test results within 12 months meet the prescribed criteria
  • Data sheet, detailed product record provided by the manufacturer (original or certified true copy)
  • Detailed information about food supplements to be declared
  • Certificate of free sale or Health Certificate (HC) or equivalent, issued by a competent state agency of origin, showing that the product is safe for consumers' health and suitable with Vietnamese law on food

3. Place to submit documents

Ministry of Health – Department of Food Safety and Hygiene.

4. Application approval time

  • For the declaration of domestically produced food supplements: from 10 to 15 days.
  • For the declaration of imported food supplements: from 20-25 days.

5. Which organizations and individuals must declare food supplements?

  • Enterprises producing and trading in domestically produced functional foods with business registration in Vietnam
  • Representative of a foreign company that has introduced health food products to the Vietnamese market.
