1. What is a cosmetic advertising license?
Cosmetic advertising license is a license issued by the Department of Health to an advertising unit after examining the application for certification of advertising content and finding that the application is complete and valid, only after being granted an advertising certificate, the advertising unit can conduct advertising cosmetic products.
2. What products are classified as cosmetics?
These following products are classified as cosmetics:
• Makeup powders, powders used after bathing, toilet powders,...
• Masks (except chemical peels)
• Products used for lips
• Color coatings (liquid, paste, powder)
• Bath soap, deodorant soap,...
• Perfume, perfume for toilet use,....
• Products for bathing or washing (salts, soaps, oils, gels,...)
• Anti-aging wrinkle products
• Hair removal products
• Creams, emulsions, milks, gels or oils used on skin (hands, face, feet, ...)
• Deodorant and anti-odor
• Skin whitening products
• Hair care products: (Dyeing and bleaching, curling irons, straighteners, curlers, styling products, cleaning products (milk, powder, shampoo)
• Hair nutrition products (milk, cream, oil), hair styling products (milk, hairspray, wax)
• Shaving products (creams, soaps, milk,...)
• Makeup and makeup remover products for face and eyes
• Products used for caring and decorating nails
• Products for external cleaning
• Products for dental and oral care
• Sunscreen products
• Products tans the skin without sunbathing.
According to the provisions of the Law on Advertising and guiding documents, cosmetic advertising is a form of advertising that requires a license for advertising content.
Businesses are only allowed to advertise cosmetic products when they are licensed by the licensing agency to advertise cosmetics.
Thus, it can be seen that cosmetic advertising is a type of conditional advertising and is censored by the licensing agency before advertising.
3.Document need to prepare to apply for a cosmetic advertising license
• Written proposal to confirm cosmetic advertising content
• Copy of Business Registration Certificate
• Receipt slip for cosmetic announcement
• Valid and reliable documents proving the product's features, uses, and information in case the advertising content states features, uses, and information not included in the receipt of the cosmetic announcement certified by the competent authority
• Samples of product labels or samples of product labels that have been approved by a competent health authority in case where it is required by law that the product label must be approved by a competent health authority
• Certificate of trademark registration in case of using trademark in advertising content
• If advertising on television: video discs, audio discs; the proposed advertising script, which clearly describes the content, the intended means of advertising, the image part, the lyrics part, the music part
• If advertising on other media: maket the proposed content of printed advertisement
• If advertising through seminars, conferences, events:
- Confirm advertising content for advertising samples used in the program
- The program must clearly state the name of the report content, time (day/month/year), venue (specific address)
- Content of reports and presentation materials, distributed to attendees; list of names, scientific titles and professional qualifications of the reporter.
Note:
• In case the unit request the certificate of advertising content is an authorized unit, it must have a valid authorization letter enclosed with a copy of the Business Registration Certificate.
• If references, proofs and authentication information in the advertisement content are in a foreign language other than English, must be translated into Vietnamese and enclosed with the original language documents.
