1. What is a work permit?

Work permit is a permit issued by a competent state agency of Vietnam to a foreigner to work legally in Vietnam.

On the work permit, there is clear information about the employee such as: name of the company/enterprise that will work, address of the company, position held, title, professional qualifications, validity period of the work permit,...

2. The role of work permit for foreigners working in Vietnam

Legally, work permit is a tool to protect foreigners when they work in Vietnam and ensure their employment is legal, avoiding legal risks. Accordingly:

  • Foreigners must present work permit when carrying out immigration-related processes at the request of a competent state agency.
  • Foreigners working in Vietnam without work permit (unless exempted) will be expelled from Vietnam according to the government regulations.
  • Businesses that hire foreigners without work permit will face administrative sanctions.

In addition, work permit help foreigners stay longer in Vietnam. At the end of the term, the foreign worker may be able to obtain a work permit extension for the same maximum duration (not including passport replacement).

3. Requirements for issuing work permit to foreigners

  • Be 18 years or older and have full civil action capacity
  • Vietnamese visa must be valid
  • Must have a guarantor company to work in Vietnam (Vietnamese company or foreign company with a branch in Vietnam)
  • Not being a person who is currently serving a sentence, hasn't had a criminal record remission or being examined for penal liability in accordance with foreign or Vietnamese laws.
  • The work permit must have a bachelor's degree, a master's degree or a degree from the program of study that must be equivalent to the field of work.

4. Documents to prepare to submit a work permit application

  • Work permit application form
  • Medical certificate of medical examination abroad or medical examination certificate in Vietnam in qualified hospitals and medical institutions as prescribed by the Ministry of Health (valid within 12 months)
  • Certified copy of passport (bring original passport valid for more than 2 years and visa)
  • 02 4x6cm photos with white background, without glasses (taken within 3 months)
  • Judicial record card No.1/ Document certifying that the foreign worker is not a person who is serving a sentence or hasn't had his criminal record cleared or is being examined for penal liability, granted for no more than 6 months
  • Documents and papers proving that they are managers, executives, experts, technical workers and a number of occupations and jobs (documents of foreign organizations must be consularly legalized together with their translations notarization – submit originals, do not use certified copies)
  • Original written approval of the foreign worker submission
  • Authority to sign documents if not signed by the legal representative of the enterprise
  • Certified copy of the company registration certificate
  • Letter of permission to submit an application.

Submit the application to the Department of Labour, Invalids and Social Affairs (with results after 5 days of submitting a complete and valid dossier).

5. Duration of the work permit

The duration of the work permit is granted depending on the duration of the work permit application (employment contract, agreement...) but not more than 02 years.
