1. HS and import tax on electronic scales:
The HS code of imported goods will be the first issue that businesses need to understand. Each type of electronic scale will have its own HS code. Based on this code, businesses will know the policies and taxes applied to the consignment.
Accordingly: Electronic scales with code HS code belong to group 8423. Specifically:
- 8423.10: scale for human, commonly used in family
- 8423.10.10: Electronic scale with an electrically operated mechanism
- 8423.10.20: electronic scale with a mechanism that does not use electricity
- 8423.82: the scale can withstand the maximum weight over 30kg but must not exceed 5000kg
- 8423.82.11: electronic scale with a maximum weight no more than 1000kg
- 8423.82.19: other types of electronic scales.
About the tax obligations of enterprises on imported electronic scales, they are regulated as follows:
- VAT is 10%
- Normal import tax ranges from 4.5%- 30%
- Preferential import tax ranges from 3%-20%
- Import tax for electronic scales originating from China with C/O form E certificate of origin is 0%.
2. PROCEDURES FOR IMPORTING ELECTRONIC SCALES:
Step 1: Register for approval of the electronic scale sample.
To register for approval of electronic scale samples, enterprises need to prepare the following documents:
- Related technical documents: detailed catalog and ISO of products
- Copy of Business License
- Product samples
- Labels of electronic scale
- Customs declaration (draft).
Some cases are exempted from sample testing procedures:
- Electronic scale has a certificate of approval of the model of the Organisation Internationale de Métrologie Légale (OIML)
- Electronic scale with a certificate of sample approval from a competent metrology agency of a country that has Vietnam's recognition for the test results of that measuring instrument
- Electronic scale according to the approved form of another importing establishment and with the written consent of that establishment
- Electronic scales in the synchronous line are imported according to the project approved by the competent state agency.
Steps to proceed with sample approval:
- Sign up for sample approval
- Conduct sample testing
- Decide sample approval.
Step 2: Prepare documents for customs clearance.
The set of customs procedures for importing electronic scales that businesses need to prepare will include the following documents:
- Commercial Invoice
- Registration for Sample Approval
- Certificate of goods' origin
- Detailed catalog of the whole consignment
- Customs declaration
- Commercial contract
- Goods packing slip
- Certificate of Origin (C/O)
- Bill of lading.
Submit the registration form to the Customs to request to bring the goods to the warehouse for preservation and inspection.
Step 3: Register for sample testing, bring samples for testing.
Step 4: Submit sample approval results to customs and clearance.
